 Review of Guardianship Orders

Shannon Leslie Byrne

(1)  The Tribunal has the authority to review any guardianship order on its own initiative. (2)  The Tribunal is required to review each guardianship order—
(a)  upon the request of any person who is eligible to request a review of the order, and
(b)  when the period for which the order is in effect expires.
(3)  Notwithstanding subsection (2) (b)—
(a)  a review required by that paragraph may begin before the specified period expires, and
(b)  the Tribunal is not obligated to review a guardianship order under that paragraph if the order includes a statement (as mentioned in section 16 (2A)) indicating that the order will not be reviewed at the end of its effective period.
(4)  Prior to conducting the review, the Tribunal must ensure a notice is served on each party involved in the proceedings, specifying the date, time, and place of the review. The review is considered to have started when such a notice is issued.
(5)  A failure to serve notice in accordance with this section does not invalidate the Tribunal's decision on the review.
(6)  If a review of a guardianship order begins but is not completed before the specified period in the order expires, the order is considered extended until the review is completed.
