Tribunal's Authority to Grant Consent


(1)  After reviewing an application for consent to perform medical or dental treatment on a patient governed by this Part, if the Tribunal determines that the treatment is suitable, it may authorize the treatment to proceed. (2)  When evaluating such an application, the Tribunal must consider—
(a)  the opinions (if any) of—
(i)  the patient,
(ii)  the individual proposing the medical or dental treatment for the patient,
(iii)  any individuals responsible for the patient, and
(iv)    (Repealed)
(b)  the considerations mentioned in section 42 (2), and
(c)  the objectives of this Part.
(3)  This section does not obligate the Tribunal to review an application concerning a patient unless it is convinced that the applicant has a legitimate interest in the patient's health and well-being.
